HC Deb 23 November 1978 vol 958 cc685-6W
Mr. Kilroy-Silk

asked the Secretary of State for the Home Department if those prisoners currently subject to disciplinary proceedings at Gartree prison will be entitled to address the board of visitors, to call witnesses and to cross-examine as recently decided by the Appeal Court.

Mr. Merlyn Rees

The prison rules require that in disciplinary proceedings a prisoner shall be given a full opportunity of presenting his own case, and the prison department's standard procedure for the conduct of adjudications which boards of visitors were urged to adopt last year, includes provision for the accused to question the reporting officer and witnesses in support of the case and for witnesses named by the accused to be called unless the board is satisfied that they could not give useful evidence. The Court of Appeal's recent judgment that adjudications by boards of visitors are open to judicial review has been brought to the attention of all boards of visitors.
