HC Deb 14 June 1976 vol 913 c39W
Mr. Robertson

asked the Secretary of State for Scotland if he will list statutory provisions which lay on him the responsibility for ensuring that the provisions of the Education Acts are complied with and, in particular, that children of school age attend school.

Mr. McElhone

The duty to enforce attendance at school rests on education authorities. Sections 35 to 44 of the Education (Scotland) Act 1962, as amended, describe the procedures which may be followed for this purpose. Section 71 sets out the enforcement powers of the Secretary of State where he is satisfied that a duty imposed by the Act has not been discharged.
