HC Deb 19 November 1974 vol 881 cc400-1W
Mr. McCrindle

asked the Secretary of State for the Home Department how many deportees are granted legal aid for any subsequent legal appearances after sentence by a court.

Mr. Alexander W. Lyon

If the hon. Member is referring to the exercise of the right of appeal against the country of destination named in the removal directions, such a person can, if he wishes, be represented without charge by the United Kingdom Immigrants Advisory Service. Legal aid is not available for these proceedings or for other proceedings before the Imigration Appeals Tribunal or the adjudicator.

Mr. McCrindle

asked the Secretary of State for the Home Department over the past two years how much deportation has cost in fares and prison accommodation.

Mr. Alexander W. Lyon

£349,721.

Mr. McCrindle

asked the Secretary of State for the Home Department what is the average period of detention in custody from arrest to deportation of persons subsequently deported.

Mr. Alexander W. Lyon

The average period from the date of conviction, or from the normal release date where a term of imprisonment has been imposed, is about 50 days. The longest delays are due to the exercise or attempted exercise of rights of appeal, or arise in cases where it is necessary to obtain a travel document from the prisoner's national authorities. I regret that particulars of the periods between arrest and conviction are not available.
