HC Deb 04 May 1938 vol 335 cc889-90W
Sir F. Sanderson

asked the Minister of Transport whether he is aware that, whilst the railway companies have agreed to compensate the holders of cheap tickets in the case of accidents, they are under no legal obligation to do so; and, in view of the fact that the present legal position discriminates against the poor and in favour of the rich, will he take steps to make it compulsory upon the railway companies to compensate those who travel by cheap tickets, just as they must compensate those who are injured when full fare has been paid?

Mr. Burgin:

I would refer my hon. Friend to the statement which I made in reply to questions on 13th April. It will be seen from that statement that there is a common law liability on the railway companies and that they have given an undertaking not to seek to exempt themselves from this liability in relation to the holders of cheap tickets in certain circumstances. I am satisfied that the railway companies will implement that undertaking.
