To ask the Secretary of State for the Environment, Transport and the Regions what plans he has to amend Part XI of the Housing Act 1985 to remove hotels, guest houses and self catering accommodation previously converted from a house which was once occupied by a single household from being categorised as houses in multiple occupation following the recent decision by the Court of Appeal on the Living Waters Conference Centre, Conwy; and if he will make a statement. We plan to issue a consultation document on proposals for a licensing scheme for houses in multiple occupation (HMOs) early in the New Year. In that paper, we will also seek views on changes to Part XI of the Housing Act 1985, including the HMO definition. However, we would be reluctant to remove from the definition any premises which provide accommodation for people who have no other home. We would also need to consider the effect on the existing powers for local authorities to make HMO registration schemes containing special control provisions.
