asked Her Majesty's Government:

To what extent they contend, in view of Article 1(3) of EC Council Regulation 2408/92, that a parallel airport agreement to the 1987 Gibraltar Airport Agreement requiring three governmental approvals for route authorisation would be compatible with EC air liberalisation measures; and, if not, whether they think EC law should take precedence.

The Government do not consider that an agreement of the kind described would be compatible with Council Regulation 2408/92. EC law would take precedence. It is for this reason that the Government believe that some details of the 1987 Gibraltar Airport Agreement need to be updated, as I indicated in my reply to my noble friend's Question of 16 June 1994.
