Whether the advertising and sale of draught Guinness in cans constitutes an offence under the Trade Descriptions Act.

The Trade Descriptions Act makes it an offence to apply a false trade description to any goods in the course of trade or business. Whether an offence is committed in any particular case is a matter for the courts to decide.
