Mr. Bessell

asked the Secretary of State for Defence whether, in view of the fact that his Department has mislaid its records of the service to the Royal Air Force of Mr. Jan Ellery of 16 King Street, Lostwithiel, Cornwall, he will arrange for Mr. Ellery to receive a pension.

Mr. Richard:

I regret that it has not been possible to trace any record of Mr. Ellery's civilian employment with the Air Ministry in 1940 but on the basis of the information provided, Mr. Ellery has no entitlement to a pension from the Ministry of Defence.

A claim for compensation for any injury arising out of employment with a Service Department would fall to be dealt with under a Government scheme similar to the provisions made in the Workman's Compensation Act. However, as he suffered no physical injury or industrial disease neither of the two appropriate classes would have applied to Mr. Ellery. No compensation would fall therefore to be paid by the Ministry of Defence.
