73 Clause 23, page 27, line 33, at end insert— (1A) The governing body and the head teacher of every aided and special agreement school shall, in the circumstances mentioned in subsection (2) below, consider any representations made to them by the local education authority.".

My Lords, I beg to move that the House do agree with the Commons in their Amendment No. 73. The local education authority's reserve power under Clause 23 to intervene in the event of the breakdown of discipline does not extend to aided and special agreement schools, quite properly, given these schools' distinctive status under the Education Acts. Local education authorities will, however, have a legitimate interest if good order is at risk in these schools which form part of their maintained provision. It therefore seems right by Amendment No. 73 to lay a duty on the governing bodies of aided and special agreement schools at least to consider any representations the local education authority may make on these matters.
