Clause 6, page 3, line 42, leave out from ("shall") to end of line 44 and insert ("make a request to that effect in writing to that person.

(3) Where any such request as aforesaid has been made to a person, the Commission shall not issue an authorisation under this section unless it appears to them that he has become unable or unwilling to comply with the terms of the request").

My Lords, subsection (1) of Clause 6 provides that where the Commission are satisfied that marauding deer are causing damage that is likely to be continued they shall authorise someone to kill the deer. But subsection (2) provides that where they are also satisfied that they know from which land the deer are coming, and that the owner or the shooting tenant of that land will forthwith undertake the killing of the deer, they shall not issue an authorisation but shall instead give him an opportunity of doing so at their request. The effect of the Amendment is to ensure that if it becomes apparent that he cannot or will not comply with the request, the Commission shall then authorise someone else, for example one of their own stalkers, to undertake the killing without further delay. I beg to move that this House doth agree with the Commons in the said Amendment.
