HL Deb 30 July 1951 vol 173 c14

Clause 19, page 12, line 10, leave out from ("Act") to end of line 19, and insert ("which has been committed by a body corporate is proved to have been committed with the consent or connivance of, or to be attributable to any neglect on the part of, any director, manager, secretary or other similar officer of the body corporate, or any person purporting to act in any such capacity, he as well as the body corporate shall be deemed to be guilty of that offence and shall he liable to he proceeded against arid punished accordingly.")

LORD MACDONALD OF GWAENYSGOR

My Lords, this Amendment brings the provisions relating to offences committed by corporations in line with other Amendments which have been made and accepted in other Bills during this Session. I beg to move.

Moved, That this House do agree with the Commons in the said Amendment.—(Lord Macdonald of Gwaenysgor.)

LORD LLEWELLIN

My Lords, I think this Amendment effects a great improvement. This measure went through your Lordships' House without your Lordships—including myself, particularly—noticing this point. There was considerable discussion about this particular problem on a Bill which came to us just after this one, and a very satisfactory form of words was found. I am glad that the opportunity has been taken of the proceedings in another place to bring this Bill into line with what was agreed on one or two other measures, and I thank the noble Lord.

On Question, Motion agreed to.
