My Lords, the object of subsection (4) of Clause 6 is to confer finality on a Court of Session decree in an action of declarator ob non solutum canonem, which is the action whereby a superior can recover feued land if the feu-duty goes unpaid for a certain time. As these actions can also be brought in the Sheriff Court, it was thought desirable to confer a like degree of finality on decrees obtained there. I beg to move that this Amendment be agreed to.
