HL Deb 17 May 1938 vol 109 cc27-8

[The references are to Bill No. 15.]

Clause 2 page 2, line 14, at end, insert— ("(3) This section shall be deemed to have had effect as from the commencement of the Act of 1924.")

LORD STRATHCONA AND MOUNT ROYAL

My Lords, the object of this and the other Amendments made to the Bill since it left your Lordships' House is to make further minor improvements which have been suggested as necessary and desirable. The 1924 Act permitted reference in an abbreviated form only to deeds containing descriptions, but the Act has been regarded in some quarters as sanctioning a similar shorthand reference to deeds containing burdens, etc. The Bill now authorises the latter practice specifically, but it has been represented that, if such authorisation is given as from the date of the coming into operation of the Bill, doubt may be cast on deeds executed prior to that date, and the authorisation has therefore been made retrospective. I beg to move that we agree to the Amendment.

Moved, That this House doth agree with the Commons in the said Amendment.—(Lord Strathcona and Mount Royal.)

On Question, Motion agreed to.
