1C.—

  1. (1) The Human Rights Act 1998 shall not be modified.
  2. (2) Sub-paragraph (1) does not apply to the modification of sections 12 and 20 of that Act, so far as those sections relate to the exercise of a power by a member of the Scottish Executive.
  3. (3) Sub-paragraph (1), read with section 28(2)(b), is to be disregarded for the purpose of determining whether the exercise of any function (other than a function of making, confirming or approving subordinate legislation so far as it modifies that Act) is within or outside devolved competence.

  4. (4) Sub-paragraph (3) does not apply to the exercise of a function under any of sections 1, 5 and 14 to 17 of that Act.
