37.—(1) In the circumstances mentioned in sub-paragraph (2), section 3 of and Schedule 2 to the Marriage Act 1949 (consents to marry) shall continue to have effect regardless of the amendment of that Act by paragraph 3B of Schedule 10.

(2) The circumstances are that—

  1. (a) immediately before the day on which paragraph 3B of Schedule 10 comes into force, there is in force—
    1. (i) an existing order, as defined in paragraph 5(1); or
    2. (ii) an order of a kind mentioned in paragraph 16(1); and
  2. (b) section 3 of and Schedule 2 to the Act of 1949 would, but for this Act, have applied to the marriage of the child who is the subject of the order.
