I beg to move amendment No. 5, in page 14, line 35, leave out `or' and insert '(a) (on an appeal under that Part against conviction—)

  1. (i) substitutes a verdict of guilty of another offence;
  2. (ii) in a case where a special verdict has been found, orders a different conclusion on the effect of that verdict to be recorded; or
  3. (iii) is of the opinion that the case falls within paragraph (a) or (b) of section 6(1) of that Act (cases where the court substitutes a finding of insanity or unfitness to plead); or'.
The amendment enables the Court of Appeal to make a defendant's costs order where, on an appeal against conviction, it substitutes a verdict of guilty of another offence, orders the recording of a different conclusion of the effect of a special verdict, or substitutes a finding of insanity or unfitness to plead.
