HC Deb 02 May 1985 vol 78 cc516-7
The Parliamentary Under Secretary of State for Scotland (Mr. John MacKay)

I beg to move amendment No. 28, in page 20, line 1, after 'hearing)', insert '—(a)'.

Mr. Deputy Speaker

With this it will be convenient to discuss Government amendments Nos. 29 and 30.

Mr. MacKay

These amendments are simple and technical. Their purpose is to ensure that the accepted policy intention on the 3 days and 14 days is properly achieved. I hope that they satisfy doubts expressed in Committee by the hon. Member for Glasgow, Garscadden (Mr. Dewar).

Amendment agreed to.

Amendments made, No. 29, in page 20, line 2, at end insert

'; and '(b) for the words from "for", where last occurring, to the end there shall be substituted the words "after whichever is the earlier of the following—

  1. (a) the expiry of 14 days beginning with the day on which he was first detained;
  2. (b) the disposal of the application by the sheriff.".'.

No. 30, in page 20, leave out lines 17 and 18 and insert 'after whichever is the earlier of the following—

  1. (i) the expiry of 3 days beginning with the day on which he was first detained;
  2. (ii) the consideration of his case by the children's hearing.'.—[Mr. MacKay.]
