Lords amendment" No. 47, in page 19, line 41, leave out "prejudice the investigation" and insert prejudice—

  1. (a) that investigation;
  2. (b) the investigation of an offence other than the offence for the purposes of investigating which the thing was seized; or
  3. (c) any criminal proceedings which may be brought as a result of—
    1. (i) the investigation of which he is in charge; or
    2. (ii) any such investigation as is mentioned in paragraph (b) above."

I beg to move, That this House doth agree with the Lords in the said amendment.

The amendment permits the police to refuse someone access to an article which has been seized from him on the grounds not only that that would prejudice the investigation but that it would prejudice other investigations or criminal proceedings.
