`(1) Where, on application made by a constable, a justice of the peace is satisfied that there are reasonable grounds for believing—

  1. (a) that a serious arrestable offence has been committed; and
  2. (b) that relevant evidence is in certain premises; and
  3. (c) that it would be of substantial value (whether by itself or together with other evidence) to the investigation in connection with which the application is made; and
  4. (d) that it is not excluded material or special procedure material; and
  5. (e) that any of the conditions specified in subsection (2) below applies,
he may issue a warrant authorising a constable to enter and search the premises, using reasonable force if necessary. (2) The conditions mentioned in subsection (1)(e) above are—
  1. (a) that it is not reasonably practicable to communicate with any person entitled to grant entry to the premises;
  2. 131
  3. (b) that it is reasonably practicable to communicate with a person entitled to grant entry to the premises but it is not reasonably practicable to communicate with any person entitled to grant access to the evidence;
  4. (c) a person entitled to grant entry to the premises or access to the evidence has unreasonably refused a constable such entry or access;
  5. (d) that the evidence is likely to be concealed, disposed of, altered or destroyed if such entry or access is sought without a warrant.
(3) A warrant under this section may authorise persons to accompany any constable who is executing it. (4) In this Act "relevant evidence", in relation to an offence, means anything that would be admissible in evidence at a trial for the offence. (5) The powers conferred by this section are in addition to any powers otherwise conferred. '.—[Mr. Whitelaw.]
