§ SCHEDULES 7A TO 7D TO THE CRIMINAL PROCEDURE (SCOTLAND) ACT 1975 AND SCHEDULES 6 AND 7 TO THIS ACT
§ Lords amendment: No. 151, in page 49, line 40, leave out "Subsection (3) above does" and insert
"The amendments provided for in Schedule 8 to this Act, other than paragraph 4 thereof, do"
§ The Solicitor-General for ScotlandI beg to move, That this House doth agree with the Lords in the said amendment.
§ The Solicitor-General for Scotland:These amendments are designed to make it clear that the district court can impose fines of up to £500 for common law offences in respect of which proceedings have been instituted after schedule 8 comes into force, even if the offences were committed before that schedule comes into force. That is desired because the increase affected by schedule 8 in the district courts' sentencing power for common law offences is in the nature of a jurisdiction change rather than an increase in criminal penalties.
