HC Deb 21 October 1982 vol 29 c516

CONSECUTIVE TERMS AND AGGREGATE PERIODS OF DETENTION

Lords amendment: No. 9, in page 5, line 15, leave out from "that" to " ; and" in line 17 and insert the only appropriate method of dealing with him is to pass a custodial sentence on him.

Mr. Mayhew

I beg to move, That this House doth agree with the Lords in the said amendment.

The amendment harmonises the wording of clauses 3, 4 and 5. Clauses 3 and 5 require a court, in dealing with an offender, to be satisfied that the only appropriate method of dealing with him is to pass a custodial sentence on him". Clause 4, on the other hand, expresses the same provision in the words a custodial sentence would be appropriate for the offence. The amendment deletes those words from clause 4 and replaces them with the expression used in clauses 3 and 5, which are in negative terms.

Question put and agreed to.
