Lords amendment: No. 18, after clause 44 insert the following new clause— In subsection (2) of section 22 of the Sea Fish (Conservation) Act 1967?

  1. (a) in the definition of "the appropriate Minister" the words "and Wales" shall be omitted and after "Minister of Agriculture, Fisheries and Food" there shall be inserted "in relation to Wales, means the Secretary of State concerned with the sea fishing industry in Wales";
  2. (b) in paragraph (a) after "Scotland" there shall be inserted "Wales";
  3. (c) in paragraphs (b) and (c) for "the Secretary of State" there shall be substituted "the Secretaries of State respectively" and after "Scotland" there shall be inserted "and Wales"."

There is nothing dramatically new in the amendment. In 1978 some fishery functions were transferred from the Minister of Agriculture, Fisheries and Food to the Secretary of State for Wales. Certain matters in respect of that transfer were overlooked in the earlier stages of the Bill. The functions to be exercised by the Secretary of State for Wales are made clear in conformity with what has already been agreed to and with established practice.
