I beg to move amendment No. 39, in page 24, line 26, leave out from 'judge' to 'shall' in line 28 and insert— '(i) in giving a direction, whether or not sought under paragraph (b) below; or (ii) in response to a request made under that paragraph)'.

With this it will be convenient to take Government amendment No. 40.

The amendment will secure that the new provisions in clause 24 do not adversely affect the existing power of a judge to recall a jury shortly after it retires to give it a direction which he omitted to give it during his summing up. As drafted the reference in the subsection is to the jury seeking rather than receiving a direction. It is for clarification purposes that the amendment has been introduced.
