HC Deb 23 May 1978 vol 950 c1419
Mr. Armstrong

I beg to move Amendment No. 21, in page 4, line 36, leave out: 'by the Secretary of State'. This is a technical amendment. Under Section 41 of the Building Societies Act 1962, a building society acknowledging receipt of an advance has to incorporate certain provisions of the Act in that acknowledgment. Clause 3(4) disapplies Section 41 in cases where a building society makes an acknowledgment to the Secretary of State of an advance under this scheme. In Northern Ireland, however, such an acknowledgment would be made to the Department of the Environment for Northern Ireland, and the disapplication would be ineffective. The purpose of this amendment is therefore to extend the disapplication of Section 41 of the Building Societies Act to cover acknowledgments made by British building societies operating in Northern Ireland. It is achieved simply by removing the phrase by the Secretary of State".

Amendment agreed to.
