§ Mr. Barney Hayhoe (Brentford and Isleworth)I beg to move Amendment No. 10, in page 2, line 16, at end insert—
'(cc) the employer had not applied to the Service for a variation or revocation of the 1933 recommendation under section 13 of the Employment Protection Act 1975 or otherwise challenged the validity of the recommendation in an application to the High Court; and'.The amendment flows from an assurance given by the sponsor of the Bill in Committee. We were then talking of what would trigger off the procedures laid down in the Bill. I think that the hon. Member for Bethnal Green and Bow (Mr. Mikardo) agreed—
