I beg to move Amendment No. 133, in page 44, line 23, leave out from first 'the' to second 'the' in line 26 and insert: 'the relevant date'. The purpose of this amendment is to ensure that a debt in respect of maternity pay which occurs both after the date of termination of employment and the date of insolvency becomes a payment by the redundancy fund under the clause. It arises out of discussions in Committee, and I hope that it is acceptable to the House.

Amendment made: No. 134, in page 44, line 32, at end insert— '(1A) In this section the "relevant date" in relation to a debt means—

  1. (a) as respects maternity pay, the date of the employee's application to the Secretary of State under this section; and
  2. (b) as respects any other debt, the date on which the employer became insolvent or the date of the termination of the employee's employment, whichever is the later. '.—[Mr. John Fraser.]
