HC Deb 30 April 1975 vol 891 cc642-3
Dr. Summerskill

I beg to move Amendment No. 26, in page 5, line 9, leave out 'Subject to subsection (2) below,'.

Mr. Deputy Speaker

With this amendment we shall take Government Amendments Nos. 27 to 31 and No. 58.

Dr. Summerskill

These amendments have two aims. In the first place they will enable societies or local authorities to count their permitted maximum number of lotteries in relation to any period of 12 months. The Government undertook to look at this following discussion of an amendment put down by my right hon. and learned Friend the Member for Hackney, North and Stoke Newington (Mr. Weitzman) and my hon. Friend the Member for St. Pancras, North (Mr. Stallard) which would have related local lotteries to the local authority financial year. The Government have also taken account of the point raised by the right hon. Member for Crosby (Mr. Page) who wanted a similar provision for societies working to the financial rather than the calendar year. By replacing the term "year" by the expression "period of twelve months", societies and local authorities are bound by neither the calendar nor the financial years. The definition of "year" in Clause 15(1) thus becomes unnecessary and a later amendment is designed to remove this definition.

Otherwise, these amendments are only drafting amendments designed to improve the general layout of Clause 8 and in particular to remove the erroneous reference in subsection (4) to which the hon. Member for Hackney, North and Stoke Newington drew attention in Standing Committee.

Amendment No. 58 will remove the definition of "year" from Clause 15 and is consequential on the earlier amendments to Clause 8. The word "year" is no longer used in the Bill.
