SEWERAGE AND SEWAGE DISPOSAL

I beg to move Amendment No. 32, in page 17, line 43, leave out subsection (5) and insert— '(5) Before constructing, diverting or closing a public sewer in the area of a local authority a water authority shall consult the local authority and the water authority shall inform a local authority of the construction, diversion or closure of a public sewer by the water authority in the area of the local authority'. This amendment fulfils an undertaking that I gave in Committee in response to an amendment moved by the hon. Member for Widnes (Mr. Oakes) requiring a water authority to consult the district or London borough council before constructing, diverting or closing a public sewer. The amendment preserves the requirement on a water authority to inform the district or London borough council of the construction, diversion or closure of a public sewer after it has taken place so that the council can keep its map of public sewers up to date.
