Lords Amendment: No. 56, in page 101, line 34, at end insert:
. Anything authorised or required by or under this Act or any other enactment to be done by the Director, other than the making of a statutory instrument, may be done by any member of the staff of the Director who is authorised generally or specially in that behalf in writing by the Director.
§ Mr. EmeryI beg to move, That this House doth agree with the Lords in the said amendment.
We have been advised that it would be unsafe to assume that the director will 666 have an inherent power to delegate his statutory duties to his staff. In certain circumstances that would obviously be nonsense, and the amendment is designed to put the position beyond legal challenge.
