Lords Amendment: No. 12, in page 51, line 4, at end insert:
(2A) In relation to the question whether any such result as is mentioned in section 64(1)(a) of this Act has arisen, a merger reference may be so framed as to require the Commission to confine their investigation to the supply of goods or services in a specified part of the United Kingdom.

This amendment and those to Clause 75 are concerned with the framing of merger references. Lords Amendment No. 12 restores to the merger provision of the Bill the effect of the last four lines of Section 6(4) of the Monopolies and Mergers Act 1965 which says that "the reference may be so framed as to require the Commission to confine their investigation to the supply of goods or services in a specified part of the United Kingdom". It provides that in cases where a reference is so made it must specify which part of the United Kingdom is relevant.
