It repairs an omission in the Bill to which attention was drawn in Committee. The existing definition in Clause 88(6)(b) of the "relevant parties" with whom the Director will be required to negotiate undertakings following an adverse report of the Commission on a merger reference refers only to persons in control of enterprises which have ceased to be distinct. This amendment deals with the more normal situation where a reference has been made in anticipation of a merger and it enables the Director to negotiate undertakings with persons who may be proposing to take over an enterprise in the merger situation.
