(1) Where notice of a proposal to make an application to the Industrial Court under section (Application to Industrial Court for reference as to recognition of sole bargaining agent) of this Act has been given in pursuance of subsection (4) of that section, any question which—

  1. (a) in accordance with that notice would be one of the questions proposed to be referred to the Commission, or
  2. (b) on an application made in pursuance of that notice is one of the questions proposed to be so referred, or
  3. (c) is referred to the Commission on such an application, or by virtue of section 44 of this Act is included in a reference made to the Commission on such an application,
shall be a question to which this section applies.

(2) Any question to which this section applies and which falls within paragraph (b) or para graph (c) of the preceding subsection shall for the purposes of this section be taken to be pending at any time before whichever of the following events first occurs, that is to say—

  1. (a) the Industrial Court determines not to refer any question to the Commission on the application mentioned in those paragraphs;
  2. (b) a reference made to the Commission on that application is withdrawn;
  3. (c) the peroid of six months, beginning with the date on which the report of the Commission on such a reference is transmitted to the Industrial Court, expires.

(3) A question to which this section applies, and which falls within paragraph (a) but neither within paragraph (b) nor within paragraph (c) of subsection (1) of this section, shall for the purposes of this section be taken to be pending at any time before such date as may be certified by the Secretary of State to be either—

  1. (a) the date on which agreement was reached as to the matters to which the proposed application would have related, or
  2. (b) the date on which, whether in consequence of a refusal of his offer of advice and assistance or otherwise, it became apparent that no such agreement was likely to be reached without an application to the Industrial Court.

(4) At any time when a question to which this section applies is pending in accordance with subsection (2) or subsection (3) of this section it shall be an unfair industrial practice—

  1. (a) for an employer directly concerned in a dispute relating to that question to institute, carry on, organise, procure or finance a lock-out in furtherance of that dispute, or to threaten to do so, or
  2. (b) for any person (including any trade union or other organisation of workers or any official of a trade union or of such an organisation) to call, organise, procure or finance a strike, or organise, procure or finance any irregular industrial action short of a strike, in furtherance of such a dispute, or to threaten to do so.—[Mr. R.
