HC Deb 10 March 1971 vol 813 c488
Mr. Michael Heseltine

I beg to move Amendment No. 15, in page 21, line 6, after 'provide', insert 'and maintain'.

Clause 22 provides that highway authorities shall have power to erect structures which protect the highway against snow, flood, landslide and other hazards of nature, but it does not give them power to maintain those structures. This Amendment would give them that power.

Mr. Michael Heseltine

I beg to move Amendment No. 16, in page 21, line 17, at end insert: () A highway authority shall pay compensation to any person who has sustained damage by reason of the execution by them under this section of any works on a highway. This Amendment arises from an assurance by the Minister in Committee that he would consider whether compensation should be payable in certain circumstances to those who suffer damage as a result of the execution of works on the highway under the powers given by this Clause. We readily accept that compensation should be payable in certain circumstances, and the Amendment would provide accordingly.

Amendment agreed to.
