§ Mr. Graham PageI beg to move Amendment No. 83, in page 73, line 37, 505 leave out from 'given' to end of line 38 and insert:
'in exchange for the right additional land which will, as respects the persons in whom there is vested the land over which the right is to be acquired, the persons, if any, entitled to rights of common or other rights over that land, and the public, be adequate to compensate them for the disadvantages which result from the acquisition of the right and that the additional'.The Amendment results from an assurance I gave in Committee that I would reconsider the Schedule to see whether any advantage would be gained by spelling out what was meant by the wordsadequate exchange".The Schedule adapts certain paragraphs in Schedule 1 to the Acquisition of Land (Authorisation procedure) Act 1946 to meet the situation created by the power to acquire rights compulsorily under Clause 40. The wordsadequate exchangein the new sub-paragraph (1)(b) to paragraph 11 of that Schedule, provided for in paragraph 4 of this Schedule, are meant to indicate that land to be given in exchange for common or open space land burdened by the acquisition of a right should adequately replace any advantages forfeited by the creation of the rights. The Amendment is designed to bring out and amplify this point. I think that it clarifies something which caused a little confusion in Committee, and I hope that it will be acceptable.
