§ Mr. Michael HeseltineI beg to move Amendment No. 11, in page 17, line 19, at end insert:
'and for securing that any limits of deviation which apply in relation to the centre line of that road or highway or any part thereof by virtue of subsection (2) below are indicated or stated in such manner as may be prescribed by the regulations.'
§ Mr. Deputy Speaker (Miss Harvie Anderson)It may be convenient also to take Amendment No. 13.
§ Mr. HeseltineThese are the first of a long, helpful and constructive set of Government Amendments. The purpose is to meet a point made by the right hon. Member for Sheffield, Park (Mr. Mulley) in Committee when he proposed that all plans accompanying schemes when published should show the possible 487 deviation in the line of the road. I am sure that he accepts that it is not possible on a plan to show a deviation of only a few yards, but the purpose of the Amendment is to ensure that the Secretary of State will make regulations to provide that in any accompanying document or plan there will be detail showing precisely the limits of deviation intended in each scheme. I am sure that this is the purpose which the right hon. Gentleman had in mind and we accept it.
§ Mr. MulleyI should like to express my thanks and to say that if on all the subsequent Amendments we do not say how grateful we are, the Minister will understand that that is not through any lack of good will, but simply because we want to save time. We are very grateful.
§ Amendment agreed to.
§ Mr. Michael HeseltineI beg to move Amendment No. 12, in page 17, line 20, leave out from the beginning to 'may' in line 24 and insert:
'(2) Where any such scheme or order as is referred to in subsection (1) above so provides in relation to a road or highway to which it relates or any part thereof, being such a road or highway as is referred to in that subsection, the centre line of that road or highway or that part thereof, as the case may be,'.This is in response to a comment by my hon. Friend the Member for Stratford-on-Avon (Mr. Maude) in Committee about the drafting of the Clause. The purpose of the Amendment is to ensure that a deviation of 55 yards from the published centre line may not be exceeded. It is "up to" 55 yards from either side of the centre line.
§ Amendment agreed to.
§
Further Amendment made: No. 13, in page 17, line 26, after 'yards', insert:
'on either side of the centre of that line'.—[Mr. Michael Heseltine.]
