I beg to move Amendment No. 44, in page 15, line 30, after ' adjustment ', insert ' in amount '.

I would be grateful, Mr. Deputy Speaker, if the House would also take Amendments Nos. 45, 72 and 73.

The purpose of these Amendments is to clarify the degree of flexibility allowed to a creditor when he serves a calling-up notice under the provisions of the Bill. Subsection (9) allows him to serve on the basis of the amount due from the debtor is subject to adjustment.

Amendments Nos. 44 and 45 amend the terms of subsection (9) itself to clarify the fact that interest is to be included in the statement of the amount finally determined as being due. As the subsection is at present drafted, the word " sum " in line 32 might by some be thought to apply only to the principal sum. We have tabled the Amendments on advice coming from expert bodies which have been considering the Bill, and I think that they are right.
