§ Mr. MaxwellI am sure, Mr. Speaker, that it will suit the convenience of the House to take those Amendments at the same time.
They are designed to clarify Clause 6(1) in two ways. First, the expression "capacity of a furnace" has been found to be open to more than one interpretation, and it is intended to make it clear that it refers to the volume of combustion space in the furnace and not, for instance, to the amount of fuel burnt in the furnace in a specified time. The reason for making the volume of the furnace the criterion is that any increase in the volume would involve work of constructional alteration which can be clearly identified.
In Committee in another place it was pointed out that the Clause did not deal expressly with the case in which a new furnace was substituted for an existing furnace. The Amendment provides that when a new furnace is installed after the coming into operation of the provision to replace the furnace of small combustion, space chimney height approval is required. The Amendments involve a slight change in the layout of the Clause.
The operative words are removed from subsections (1) and (2) and incorporated in subsection (10). The definition of "new chimney" in subsection (11) becomes superfluous and is deleted.
