GRANTS TOWARDS COST OF WATER SUPPLY TO AGRICULTURAL BUILDINGS

Lords Amendment No. 27, in page 36, line 25, leave out "situated on or".

I beg to move, That this House doth agree with the Lords in the said Amendment.

This is a drafting Amendment to remove superfluous words. The Clause refers to buildings situated on agricultural land, but the courts have understood "agricultural land" to exclude the site of any building, so it is impossible for any buildings to be "situated on" agricultural land as defined in the Land Drainage Acts. Clause 41 will remove doubts about the vires of the payment of grant on the supply of water to the farm buildings. We are satisfied that the amending words will cover those cases in which grant has hitherto been paid.
