asked the Minister of Transport if she will introduce legislation to ensure third party compensation for injuries and damage arising from a driver's death at the wheel.

Mrs. Castle

Accidents of this kind are fortunately rare. I not aware that in practice there are significant difficulties over compensation, but I will bear the hon. Member's suggestion in mind.

Mr. Biffen

Is the right hon. Lady aware that, although these accidents are rare, in at least two cases they have resulted in no compensation being available? If her Ministry is unable to bring forward legislation, could she give an assurance that the Ministry will cooperate in any Private Member's Bill designed to remedy the situation?

Mrs. Castle

I feel that there is a theoretical gap in our legislation here. In Practice, however, it has not proved to be of very great difficulty. I am always prepared to consider any particular case to see whether there are grounds for legislation.
