§ Dr. Dickson MabonI beg to move, That this House doth agree with the Lords in the said Amendment.
This is another drafting Amendment, on which, I understand, the most expert legal advice has been given and on which the Lord Advocate has been consulted. It is an Amendment to Schedule 3, and, therefore, to subsection (4) of Section 22 of the 1951 Act, which prohibits the use of streams for disposing of polluting matter, and so on, to insert the word "of", which had been omitted.
Since I spoke so swiftly in Committee, I will read somewhat slowly the amended form of the subsection. It will now state:
Subsection (1) of this section shall not by virtue of paragraphs (b) or (c) thereof penalise the depositing with the consent of the river purification authority of any solid refuse on any land so that it falls or is carried into a stream if no other site for the deposit is reasonably practicable and all reasonably practicable steps are taken to prevent the refuse entering the stream.I hope that this commends itself to all hon. Members.
