HC Deb 24 June 1964 vol 697 cc493-4
Mr. D. Price

I beg to move, in page 10, line 35, at the end to insert: (4) Any sum recoverable under subsection (2) of this section shall be recoverable as a simple contract debt in any court of competent jurisdiction. It might be convenient to take this Amendment with Amendment No. 8, in page 11, line 18, at the end to insert: (4) Any sum recoverable under subsection (2) of this section shall be recoverable as a simple contract debt in any court of competent jurisdiction.

Mr. Deputy-Speaker

If it is agreeable to the House, yes.

Mr. Price

These Amendments deal with cases where a sum of money is recoverable by a prospective hirer or buyer who has served a notice of cancellation. I have been advised that there is some doubt about whether an action to recover a sum of money could be brought in the county court. The purpose of these Amendments is to make it clear that the county court has jurisdiction, subject, of course, to the amount involved not exceeding £400.

Amendment agreed to.
