asked the Secretary of State for Scotland if he is aware that two Scottish trawlers were arrested by a Danish frigate while fishing off the Faroe Islands last week; and what action he is taking to safeguard the rights of Scottish trawlers while fishing in these waters.

Mr. Maclay

Yes, Sir. Fishing in the waters off the Faroe Islands is regulated by the Anglo-Danish Agreement of 1959, which provides for the exclusion of British vessels from fishing inside a line drawn roughly six miles from the Faroese coast. The Danish and Faroese authorities have the right to ensure that this limit is observed and I understand that the trawlers were arrested for infringing it. The skippers concerned have been convicted by a local court for illegal fishing and I understand that the owners are considering an appeal against this verdict. In the circumstances no immediate action seems called for in these two cases but I am keeping a close watch on the situation.

Will the right hon. Gentleman confirm or deny that these trawlers were fired on by the Danish naval vessel? Is he aware that they assert that they were outside the six-mile limit? Can he tell the House what advice they received from the British Consul before the trial took place and will he do something about the penal sentences imposed on these trawlers which in fact amount to fines of not less than £5,000?

I am sure that the hon. Member will realise that, as there is a possible appeal pending, I must be very careful in what I say.

That may have some reference to the last part of my supplementary question, but will the right hon. Gentleman answer the first part? What about the action of the British Consul to protect their rights? Will he confirm or deny that these British trawlers were fired on by this Danish naval vessel?

I understand that they received a warning. I should want notice of a Question about the full details; there are various stories on this matter. The services of the British Consul were at all times available.
