I beg to move, in page 67, line 20, to leave out from "forty" to second "the" in line 23 and to insert: or section one hundred and thirty-eight of this Act may be taken into custody in England and Wales may be taken into custody in, and returned to England and Wales from, any other part of the United Kingdom or". This Amendment goes with a later Amendment on page 91, line 8, to leave out subsection (6) of Clause 138. The effect of the two Amendments is to transfer from Clause 138 (6) to Clause 92, with which we are here dealing, the power to retake in Scotland, Northern Ireland, the Channel Islands or the Isle of Man those patients who would be liable to retake under Clause 138 if found in England and Wales. Thus all the powers to retake patients outside England and Wales will be contained in Clause 92 which will apply in these other countries powers which for England and Wales are described in Clauses 40 and 138.
