§ 35. Miss Herbisonasked the Secretary of State for Scotland if he will reconsider his decision on the case of the planning appeal in respect of the Mill Garage and Café, Mollinsburn.
§ Mr. J. N. BrowneThe Statute does not enable my right hon. Friend to reconsider a decision of this kind.
§ Miss HerbisonIs the Minister aware that my constituent feels very strongly that an unjust decision has been made, particularly when he compares it with those taken in other cases on the same stretch of road? Surely, the Secretary of State can do something to have the whole matter of these premises on this important road investigated?
§ Mr. BrowneThis matter has been most carefully investigated, and my right hon. Friend is not enabled to reconsider the decision. Of course, a new application for planning permission can be lodged, but I am advised that where there has been no change in the circumstances it is rather doubtful whether any different decision would be arrived at.
§ Miss HerbisonIf my constituent does put forward a new application, can the hon. Gentleman say whether it will be considered in line with other decisions that have been taken which seem to be much more just?
§ Mr. BrowneI could not possibly bind my right hon. Friend or anyone else. Each case will be considered on its merits.
