I beg to move, in page 38, line 37, at the end, to insert: (3) Nothing in this Act shall make it unlawful to detain an accused person in custody pending trial otherwise than in prison if such detention would have been lawful prior to the commencement of this Act. This is a consolidation Bill, and an error in the drafting of it, which I regret, was made. The purpose of the Amendment is to put that error right. The error consisted of the omission of a provision in one of the Acts that is being repealed. I hope that the Committee will accept the Amendment.

I only wish to say how glad we on this side of the Committee are that such an error has been made, which gives us one of those rare opportunities to hear the Lord Advocate. We only hope that in subsequent legislation there will be similar errors which will give us another similar pleasant opportunity.
