HC Deb 08 December 1954 vol 535 c950
51. Mr. S. Silverman

asked the Secretary of State for the Colonies whether he will now withdraw the Emergency Regulation under which it is a capital offence to receive stolen property in Kenya.

Mr. Lennox-Boyd

Receiving stolen property is not a capital offence but under Emergency Regulation 8 F (1) demanding, collecting or receiving supplies by or for terrorists is a capital offence.

Mr. Silverman

Is the right hon. Gentleman aware that, in the case to which reference has already been made—the receiving of six pieces of cloth—it has so far been held to be the commission of a capital offence under this Regulation, and, in these circumstances and in the circumstances to which I drew his attention in a supplementary question a moment ago, will he consider whether the whole basis of this tyrannical Emergency Regulation should be reconsidered?

Mr. Lennox-Boyd

Any comment from me which would have been improper on Question 50 is equally improper on Question 51.
