9.46 p.m.

Mr. Norman Cole (Bedfordshire, South)

I beg to move, "That this House doth agree with the Lords in the said Amendment."

Mr. James MacColl (Widnes)

I beg to second the Motion.

Mr. Ede (South Shields)

I think we are entitled to some explanation of this Amendment.

Mr. Cole

It is entirely a drafting Amendment to conform to the words of the Criminal Justice Act, 1948.

Question put, and agreed to.

Lords Amendment: In line 27, at end, insert: (3) The said section thirty-five shall have effect as if for the reference in paragraph (a) of subsection (1) thereof to the probation officer, or one of the probation officers, for the probation area in which the court or justices will sit there were substituted a reference to a probation officer appointed for or assigned to the petty sessional division in which the court or justices will sit. (4) For the purposes of this section and of the proviso to subsection (2) of the said section thirty-five, the expression "petty sessional division" means—

  1. (a) in the case of any place deemed to be a petty sessional division under subsection (2) of section forty-five of the Criminal Justice Act, 1948, that place;
  2. (b) in any other case, a petty sessions area within the meaning of the Justices of the Peace Act, 1949."

Mr. Cole

I beg to move, "That this House doth agree with the Lords in the said Amendment."

Mr. MacColl

I beg to second the Motion.

Mr. Ede

Is this also a drafting Amendment? It seems a pretty long piece of drafting.

Mr. Cole

The same remarks apply to it as to the previous Amendment. It is a long Amendment, but I can assure the right hon. Gentleman that the drafting is required.

Question put, and agreed to.
