The Attorney-General

I beg to move, in page 50, line 31, at the end, to insert: so however that works executed by a statutory corporation shall not be treated as executed in exercise of a statutory power by reason only of the corporation's having statutory authorisation in that behalf for the purposes of the law relating to the capacity of such corporations, and references in this Act to a statutory power to execute works shall be construed accordingly. This also is a drafting Amendment. As at present drawn, the definition of statutory power and undertakers' street works is so wide that it might include mining operations thousands of feet below the street although they do not affect the highway at all. The object of this Amendment is to deal with that case.

Amendment agreed to.

Clause, as amended, ordered to stand part of the Bill.
