I beg to move, in page 27, line 43, to leave out from "that," to the end of line 3, in page 28, and to insert: any, person has suffered damage in consequence of the order by the depreciation of any interest in the land to which he is entitled or by being disturbed in his enjoyment of the land, that authority shall pay to that person compensation in respect of that damage; and any compensation payable under this Subsection in respect of the depreciation in the value of an interest in the land shall be assessed in accordance with the provisions of the Fourth Schedule to this Act. This Amendment is put down as a result of an undertaking which I gave in Committee. As the Clause stood, if a person suffered trade disturbance without actually suffering loss of land value, he was not able to get compensation in respect of trade disturbance. This Amendment will enable such a person to get compensation in respect of trade disturbance without necessarily suffering loss of land value.

As the right hon. Gentleman said, this arose out of our proceedings in Committee. I. agree with him that the present drafting which he has suggested carries out the undertaking he gave, and I am grateful for his consideration.
