§ Mr. WestwoodI beg to move, in page 30, line 28, at the end, to insert:
Provided that nothing in a tree preservation order shall render unlawful the felling or lopping of any tree if such felling or lopping is urgently necessary in the interests of safety, so long as notice in writing of the proposed operations is given to the local planning authority as soon as may be after the necessity for the operations arise.The Joint Under-Secretary of State for Scotland in Committee undertook that we would give consideration to the inclusion of a provision in the Bill making it plain that the carrying of out of a tree preservation order would not include the lopping or felling of trees if this were necessary.
